When a person wishes to embark on the creation of a business, he will always be faced with the problem of choosing the legal form. Note that there are two main categories, so from there it won’t be hard to decide.
Individual reason companies
Individual reason is a business which is operated by an entrepreneur and which uses his own name and capital The main advantage of this form of business is that it is inexpensive, easy to set up and does not require minimal funding. The downside is that it is attached to an individual and does not offer the possibility of association which can prove to be a risk for the entrepreneur. Indeed, it will have no legal personality of its own, which means that the entrepreneur is personally responsible for the debts.
Capital companies
The capital company will generally be founded by several people. Its legal personality will be quite distinct from its founders or partners. SAs and SARLs have fairly similar operating methods. Their advantages mainly concern the limitation of the risk for the entrepreneur, in particular concerning the LLC. Indeed, the latter itself responds to its social debts. The downside is that here the entrepreneur will not be able to focus on personal enrichment.
