Request for self-employment

The procedures necessary to apply for self-employment for third countries :

Switzerland is a country that is open to the various activities of third countries. In any case, there are procedures that must be followed to the letter in order to carry out the activity of the latter.

What are the first conditions?

There are several conditions that must be met before starting the activity:

  • economic interest of the project
  • foreign qualifications
  • financial conditions of the company
  • Proof of permanent residence in a neighboring country and residence in the area for at least six months (for G permits)
  • availability of quotas for B and L permits

What are the steps to follow in this request?

The request is made by the person who wants to start the activity

In general, the following objects are usually required for the application:

A completed application form M from the Foreigners Department at the Cantonal Office of Population and Migration (OCPM) (or F for a cross-border application); it is available at the Foreigners Department and can be downloaded from their website; a complete file presenting the project, indicating the precise nature of the activity, the organization as a sole proprietorship, a limited liability company (SARL), a public limited company (SA), financial forecasts, the target market (business plan)

  • the foreigner’s CV and copies of diplomas and certificates
  • proof of residence in the border area and a copy of the durable residence permit in the case of a border application
  • a copy of your valid passport
  • two passport size photos

The request must be filed with the Foreigners’ Affairs Department. It is forwarded to the foreign labor service. This request is submitted to the Tripartite Commission for the Economy of the Canton of Geneva.

The procedure before the commission takes 2 to 3 weeks for routine cases. Decisions for stays of less than 4 months are made directly by the MOE between 1 and 6 days.
